Welcome to the terms and conditions ("Terms") for BookeCart Genie. These Terms are between you and BookeCart.com and/or its affiliates ("BookeCart" or "Us") and govern our respective rights and obligations. Please note that your use of the BookeCart.com website and subscription to BookeCart Genie membership are also governed by the agreements listed and linked to below, as well as all other applicable terms, conditions, limitations, and requirements on the BookeCart website, all of which (as changed over time) are incorporated into these Terms. If you sign up for a BookeCart Genie membership, you accept these terms, conditions, limitations and requirements.

Promotional Trial Memberships

We may sometimes offer trials or other promotional memberships to certain customers, which are subject to these Terms except as otherwise stated in the relevant promotional offers. Such trial or promotional memberships may be subject to conditions prescribed by BookeCart. These relevant conditions and the term / tenure for such promotional memberships may be different from the Terms. Some of such trials or promotional membership may be available to you only in the event Auto Renewal of your BookeCart Genie membership is enabled for your membership.

Membership Term

BookeCart Genie membership may be offered by BookeCart for different terms and tenures. The key memberships are described as under:

Annual BookeCart Genie Membership :

Annual Prime Membership (valid for 12 months from date & time of activation)

Six Month BookeCart Genie Membership : Six Months (valid for 6 months from date of activation)

Monthly BookeCart Membership (Promotional) : Monthly (valid for 1 month from date of activation)*

*For Monthly Genie Membership, a customer's Genie membership will be due for renewal on a monthly basis. For example, if the Monthly Genie Membership of the customer is activated at 10 a.m. on January 05, 2020, the Monthly Genie Membership shall end at 10 a.m. on February 05, 2020.

You may select the Genie membership plan of your choice and you can change the Genie membership plan at any time. The payment method(s) eligible to be used for different Genie membership plans may vary, and BookeCart reserves the sole right to determine the eligible payment methods for each Genie membership plan.

Fees

The membership fee for Genie is stated in the Genie section of our Site, linked into the main menu on the site homepage, for different membership terms, such as a monthly or annual Genie membership, which are offered. The Genie membership fee is non-refundable except as expressly set forth in these Terms. Taxes may apply on either or both of the membership fee and the reduced shipping charges for Genie.

Your Genie membership will be renewed consecutively for such terms, monthly or annual as chosen by you, (such renewal, "Auto Renewal"), if the payment method you have chosen for making payments towards your Genie membership supports Auto Renewal. In cases where you select an eligible payment method, the payment of the membership fees will be on a recurring basis (such payments, "Recurring Payments") and you authorize us to collect the membership fee for the next membership terms(s).

In the event Recurring Payments is enabled for your Genie membership, you agree to be bound by the 'Recurring Payments for BookeCart Genie - Terms & Conditions', available here.

You have the sole right to decide to cancel or disable the Auto Renewal of your Genie membership either by contacting BookeCart customer support or in the settings or preferences of your BookeCart.com account. By signing-up for Genie membership, you confirm that you are a resident of India. You cannot use a credit or debit card issued outside India to pay for any membership fee for Genie. You cannot pay for membership fee for Genie using a virtual card or virtual account by banks. Paid Genie membership only becomes effective upon successful authorization of payment or successfully enabling Recurring Payments (for Auto Renewal of your membership) through the BookeCart website (as the case may be).

If Auto Renewal of your Genie membership has been enabled your membership will renew automatically for a membership term one after the other, unless you expressly select to cancel or disable Auto Renewal or Recurring Payments for your Genie membership. For the avoidance of doubts, it is clarified that once Auto Renewal has been enabled, monthly Genie memberships renew automatically on a monthly basis and annual Genie memberships renew automatically on an annual basis.

Delivery Benefits and Eligible Purchases for BookeCart Genie

BookeCart Genie delivery benefits depends upon inventory availability, order deadlines, and the delivery address. They are limited to certain products sold on the BookeCart.com website. Products eligible for Genie benefits will be designated as such on their product pages. Some special product, order, handling fees, and/or taxes may still apply to eligible purchases. If only some items in your order are eligible for Genie benefits, you will pay applicable shipping charges for the ineligible items. For items that are not available for one-day or two-day delivery, Genie customers will receive free standard delivery. Changing or combining orders, or changing your delivery address, speed, or preferences might affect Genie eligibility. Certain purchases may only be entitled to standard shipping because of their size, weight, and other shipping characteristics.

We may also exclude products with special shipping characteristics at our discretion. Following items are excluded from BookeCart Genie delivery benefits :

1. Bangladeshi books, or any product listed on the Site, whose primary sourcing is international import.

2. Bangladeshi educational kits, or any product listed on the Site, whose primary sourcing is international import.

3. Products which are categorised under ‘Rare Items’/’Rare Products’ on the site.

4. Products categorised under ‘Loot The Box Sale’.

Other Benefits

Apart from offering products on reduced/zero delivery charges, BookeCart Genie Memebership offers Priority Shipping, No-Cost Cash On Delivery, Early Access to promotional offers, Rewards Program, Special Deals exclusively to users subscribed to BookeCart Genie memebers.

1. Priority Shipping feature depends upon inventory availability, order deadlines, and the delivery address. They are limited to certain products sold on the BookeCart.com website. It may happen, in certain situations, that one or more products are ‘unavailable’ or ‘not immediately available’ with the suppliers even after the said products are shown as ‘available; on Bookecart.com. If similar situation arises, we will inform the customer(s) about the probable delay and arrange for an instant refund or replacement, or hold the order till the product(s) are available, according the instructions of the customer(s).

2. No-Cost Cash On Delivery is a geographic area-specific feature. BookeCart Genie memebers residing in a particular area (Kolkata and Howrah as of now), or receiving deliveries in the said area are eligible for this benefit. The aforementioned geographic area has been pre-decided by BookeCart. BookeCart hold the solds rights to make any amendments to the terms of this feature at any point of time. Genie members will be able to check if they are eligible for No-Cost Cash On Delivery by entering their area postal code in the PIN code checker box on the product page.

3. Early Access to promotional offers will allow the Bookecart Genie members to access any special or promotional offer an hour before its official launch time.

4. Rewards Program is a promotional offer a Genie member may avail in the form of surprise cashbacks, extra discounts, wallet benefits or coupons.

5. BookeCart.com, from time to time, will offer Special Deals to Genie Members only.

Other Limitations

We reserve the right to accept or refuse membership in our discretion.

We may send you email and other communications related to Genie and your Genie membership (regardless of any settings or preferences related to your BookeCart account).

You may not transfer or assign your Genie membership or any Genie benefits, except as allowed in these Terms. Genie members are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using Genie benefits.

From time to time, BookeCart may choose in its sole discretion to add or remove Genie membership benefits.

Membership Activation

Your paid Genie membership will be activated only on successful payment for Genie membership made through the BookeCart.com website.

Membership Cancellation

You may cancel your Paid Genie membership any time by visiting Your Account. Please note that no refund will be issued, at any point of time, against the payment you have made to purchase the membership whatsoever.

Agreement Changes

We may in our discretion change these Terms, BookeCart Conditions of Use, Conditions of Sale and Privacy Notice, or any aspect of Genie membership, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

Termination by Us

We may terminate your Genie membership at our discretion without notice. If we do so, we will issue a credit note to you and give a prorated refund based on the remaining term of your then membership term, whether annual or monthly. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Genie membership, or is harmful to our interests or another user. It is clarified that if the Auto Renewal of your Genie membership is enabled, you will be provided a refund (in accordance with these Terms) only for such membership term for which you have been charged. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

Limitation of Liability

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN CONDITIONS OF USE AND SALE , IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO BOOKECART GENIE MEMBERSHIP. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MEMBERSHIP FEE YOU PAID. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR PRIME MEMBERSHIP.

BOOKECART GENIE OFFER TERMS AND CONDITIONS

1. From time to time, BookeCart may offer BookeCart Genie Memebership at a reduced rate in the form of an offer. This is a limited time promotional offer ("Offer") made available on www.bookecart.com and the corresponding mobile site and mobile application thereof (collectively, "BookeCart.com") by BookeCart, a venture of Manmorphosis Online Services Private Limited.

2. These offer terms and conditions ("Offer Terms") are in addition to BookeCart.com Conditions of Use & Sale to which a customer agrees by using BookeCart.com and BookeCart Genie Terms and Conditions ("Genie Terms"). In the event of any conflict between such terms and these Offer Terms, these Offer Terms will prevail with respect to this Offer.

3. BookeCart may at its sole discretion revoke the Offer without any prior notice and without any liability.

4. All applicable taxes and levies payable on the purchase of BokeCart Genie membership, including without limitation sales tax, service tax, goods and services tax etc., shall be payable by the customer purchasing the BookeCart Genie membership.

5. BookeCart reserves the absolute right to withdraw and/or alter any of the terms and conditions of the Offer at any time without prior notice, and reserves the right to remove / withdraw this Offer from at any time and without any prior notice.

6. In the event a customer fails to comply with any of these Offer Terms and/or the GenieTerms, customer will not be eligible to receive or avail the BookeCart Genie membership at the offer price under this Offer.

7. Any queries in relation to the Offer shall be addressed to BookeCart.

8. The customer is not bound in any manner to participate in or avail the Offer. This Offer is being made purely on a "best effort" basis and participating in or availing the Offer is voluntary.

9. Neither BookeCart nor any of its affiliates make any warranty of any kind, express or implied in relation to this Offer (including, without limitation with respect to the status, fulfilment of the benefits).

10. BookeCart reserves the right to disqualify any customer from the benefits of the Offer, at its sole discretion, if it identifies any fraudulent activity being carried out for the purpose of availing the benefits under the Offer or for any reason whatsoever.

11. By participating in this Offer, customer will be deemed to have accepted these Offer Terms and expressly agree that BookeCart and its affiliates will not be liable or responsible for any loss or damage whatsoever that the customer may suffer, directly or indirectly, in connection with this Offer.

BookeCart holds the sole rights to make any amendments to all the Terms pertaining to the BookeCart Genie Membership. These Terms are governed by the laws of India. Any disputes arising out of and in connection with this Offer shall be subject to the exclusive jurisdiction of the courts of Kolkata only.
